Terms and Conditions

Welcome to diginuCashBack Club. By using this platform, you agree to the following Terms and Conditions.



1. Definitions
1.1 “Abuse” means any excessive, unfair, dishonest, improper or unusual use of the Program that falls outside normal consumer behaviour, as determined by diginuCashBack Club.
1.2 “Active Member” means a Member whose membership is current, fully paid, not suspended, not cancelled and has no outstanding or failed payments.
1.3 “Bolt” means Bolt, being the third party mobility and transportation platform through which vouchers may be redeemed, subject to its own terms and conditions and privacy policies, available at https://bolt.eu/en-za/legal/
1.4 “Cashback” means the monetary reward paid to Members based on qualifying transactions.
1.5 “Chargeback” means a reversal of a payment initiated by a bank, card issuer or payment provider.
1.6 “Check in” means the process by which a Member indicates their presence at a merchant prior to a transaction.
1.7 “Claim” means a request submitted by a Member for cashback based on a qualifying transaction.
1.8 “Connectivity” means internet or network access required to use the Platform.
1.9 “Device” means any mobile phone, tablet or electronic device used to access the Platform.
1.10 “diginuCashBack / diginuCashBack Club” means diginuCashBack (Pty) Ltd, registration number 2026/226584/07.
1.11 “diginuPay Wallet” means the digital wallet where cashback and commissions are paid into.
1.12 “Effective Date” means the date on which these Terms become applicable to the Member.
1.13 “Fraud” means any act or omission intended to deceive, manipulate or unlawfully benefit from the Program, including but not limited to activities defined in these Terms.
1.14 “Free Trial” means any promotional period during which a Member is granted temporary access to the Program without payment.
1.15 “Member” means any individual who registers for and participates in the Program, and includes both Premium Members and Standard Members.
1.16 “Membership Cycle” means the recurring period linked to a Member’s subscription, being either monthly or annual from the date of activation.
1.17 “Merchant” means any business or retailer from which a Member makes a purchase.
1.18 “Payment Processor” means any third party service used to facilitate payments, including but not limited to PayFast.
1.19 “Payout” means the transfer of approved cashback or commissions into the Member’s diginuPay Wallet.
1.20 “Personally Referred Active Member” means an Active Member who registered using the Member’s unique referral link and whose membership remains active, fully paid, not suspended, not terminated, not cancelled and not expired.
1.21 “Platform” means the diginuCashBack mobile application, website and associated systems.
1.22 “Premium Member” means a Member who activated their membership by means of paying R199 (one hundred and ninety nine rand) per month or who paid R1999 (one thousand nine hundred and ninety nine rand), on the diginuCashBack mobile application, subject to clause 1.2 above.
1.23 “Processing Time” means the period required for diginuCashBack to review, validate and approve or reject a Claim.
1.24 “Program” means the diginuCashBack cashback and referral rewards system.
1.25 “Promotional Offer” means any incentive, discount or benefit offered by diginuCashBack for a limited time or subject to specific qualifying criteria.
1.26 “Public Holiday” means any official public holiday recognised in the Republic of South Africa.
1.27 “Qualifying Transaction” means a purchase that meets all requirements set out in these Terms for cashback eligibility.
1.28 “Receipt” means a valid, original, system generated tax invoice issued by a merchant as proof of purchase.
1.29 “Referral Commissions” means earnings paid to Members for referring other Members to the Program.
1.30 “Standard Member” means a Member who activated their membership by means of paying R99 (ninety nine rand) per month or who paid R999 (nine hundred and ninety nine rand), subject to clause 1.2 above. 
1.30 “South Africa” means the Republic of South Africa.
1.31 “Suspension” means the temporary restriction of a Member’s access to the Program.
1.32 “System” means the underlying technology, software and infrastructure used to operate the Platform and Program.
1.33 “Tax Invoice” means a valid tax invoice issued by a merchant and accepted by diginuCashBack for claim validation purposes.
1.34 “Termination” means the permanent cancellation of a Member’s account and participation in the Program.
1.35 “Third Party Provider” means any external service provider engaged by diginuCashBack, including but not limited to, payment processors, wallet providers, voucher providers, technology partners, benefit partners and compliance providers.
1.36 “Transaction Time” means the date and time reflected on the Receipt.
1.37 “Website” means https://diginucashback.com.
1.38 “Working Day” means any day other than a Saturday, Sunday or public holiday in South Africa.

2. Introduction
2.1 These User Terms and Conditions govern participation in and use of the Program. By registering for or participating in the Program, the Member agrees to be bound by these Terms.
2.2 These Terms constitute a legally binding agreement between diginuCashBack and the Member or Active Member.
2.3 diginuCashBack may amend these Terms from time to time. Changes will be communicated via the Platform, email, push notification, SMS, WhatsApp or other official communication channels. Continued participation in the Program after such communication constitutes acceptance of the updated Terms.
2.4 The Program is intended for personal use only unless otherwise authorised by diginuCashBack in writing.

3. Membership
3.1 Membership is available to natural persons aged 18 (eighteen) years or older, unless otherwise approved by diginuCashBack in writing.
3.2 Membership options include 
3.2.1 Standard Membership option with a monthly membership fee of R99 (ninety nine rand) or an annual membership fee of R999 (nine hundred and ninety nine rand), both options payable in advance;
3.2.2 Premium Membership option with a monthly membership fee of R199 (one hundred and ninety nine rand) or an annual membership fee of R1999 (one thousand nine hundred and ninety nine rand), both options payable in advance.
3.3 Membership remains active only while payments are up to date.
3.4 Only Active Members qualify for cashback benefits and referral commissions.
3.5 diginuCashBack may refuse, suspend or cancel membership at its discretion, subject to applicable law, but cancellation or termination of a membership by diginuCashBack  is subject to thorough investigation into any potential abuse of the Platform, including consultation with the Member(s) involved, either in writing via email or on a recorded virtual meeting, subject to the Member(s)’ willingness to resolve any matters involving suspected abuse or misuse of the platform and/or its benefits.
3.6 The Member is responsible for ensuring that payment details are valid, current and capable of processing membership payments, and that they are legally authorised to use the payment method they provide to diginuCashBack.

4. Cooling Off and Refunds
4.1 The monthly membership options, both Standard and Premium, includes a 30 (thirty) day money back guarantee applicable only during the first month from payment, provided no cashback, discount, voucher benefit or referral commission has been received.
4.2 Where a Free Trial or Promotional Offer is granted, the refund guarantee does not apply.
4.3 Refund requests must be submitted in writing within 30 (thirty) days of payment and may take up to 14 (fourteen) Working Days to process.
4.4 Except where required by applicable law, no refunds will be issued for annual memberships, renewals, suspended accounts or terminated accounts.
4.5 Upon approval of a refund, membership will be cancelled and all benefits forfeited.
4.6 The Member acknowledges that digital services may commence immediately upon activation and may waive any statutory cooling off rights where permitted by law.

5. Cashback Benefits
5.1 Cashback is available to Active Members who submit valid Claims in accordance with these Terms.
5.2 Cashback is not guaranteed and is subject to validation, compliance, fraud checks and system verification.
5.3 diginuCashBack may approve, decline, delay, audit or investigate any Claim.
5.3.1 Investigation into Claims, where applicable, may take no longer than 14 (fourteen) calendar days.
5.4 Cashback is typically processed on Fridays and paid into the Member’s diginuPay Wallet. Payout timing may be adjusted due to operational, technical, compliance, public holiday, third party or banking related reasons, but may not be delayed longer than 5 (five) working days after the first Friday following submission, subject to clause clauses 5.3, 6, 7, 8 and 9 hereof.
5.5 diginuCashBack reserves the right to amend cashback percentages, cashback categories, qualifying spend thresholds, claim limits, cashback caps, eligibility rules, partner benefits and Promotional Offers from time to time upon 30 (thirty) days notice to Members, save for in case of Force Majeure.
5.6 Promotional Offers may have additional qualifying criteria and may be amended, suspended or withdrawn in accordance with the terms applicable to such Promotional Offer.
5.7 diginuCashBack may determine the eligibility of merchants, transactions, categories and Receipts at its discretion, acting reasonably and in good faith at all times, and providing written reasons via email to the Member should a claim be rejected, and possible remedies, if applicable.
5.8 Cashback, rewards, benefits and promotional offers may be funded, supported or subsidised through one or more revenue streams, commercial arrangements, strategic partnerships, data insights, marketing initiatives, membership fees, merchant contributions, advertising revenue, platform revenues or other lawful business activities operated by diginuCashBack and its affiliates.
5.9 The funding model, commercial arrangements and revenue sources supporting the Program are proprietary to diginuCashBack and may change from time to time.

6. Restaurant Cashback
6.1 Restaurant cashback applies to restaurant and takeaway transactions within South Africa.
6.2 Members must complete a Check in at least 5 (five) minutes before the transaction time reflected in the receipt.
6.3 Transactions must occur within 5 (five) hours of the selected Check in time by the Member.
6.4 Claims must be submitted within 24 (twenty four) hours of the Transaction Time.
6.5 For Standard Members Cashback is calculated at 5% (five percent) of the total bill, subject to a minimum spend of R100 (one hundred rand) and a maximum cashback payout of R100 (one hundred rand) per Claim.
6.5.1 For Premium Members Cashback is calculated at 5% (five percent) of the total bill, subject to a minimum spend of R100 (one hundred rand) and a maximum cashback payout of R200 (two hundred rand) per Claim.
6.6 Only 1 (one) restaurant Claim per Member per day is permitted.
6.7 Claims exclude tips, fees and non product charges.
6.8 Only valid printed Tax Invoices will be accepted.

7. Fuel Cashback
7.1 Fuel cashback applies to fuel purchases within South Africa.
7.2 Members must complete a Check in at least 5 (five) minutes before the transaction time.
7.3 For Standard Memberships Cashback is calculated at 1% (one percent) of the total purchase, subject to a minimum spend of R100 (one hundred rand).
7.3.1 For Premium Memberships Cashback is calculated at 5% (five percent) of the total purchase, subject to a minimum spend of R100 (one hundred rand).
7.4 Claims must be submitted within 24 (twenty four) hours of the Transaction Time.
7.5 A valid system generated Tax Invoice is required.
7.6 For Standard Members monthly limits apply to a maximum cashback payout of R250 (two hundred and fifty rand) per month and R100 (one hundred rand) maximum payout per claim.
7.6.1 For Premium Members monthly limits apply to a maximum cashback payout of R500 (five hundred rand) per month, R125 per week and R100 (one hundred rand) maximum payout per claim.
7.7 Only 1 (one) fuel Claim per Member per day is permitted on both Standard and Premium members.

8. Grocery Cashback
8.1 Grocery cashback applies to grocery purchases within South Africa.
8.2 Members must complete a Check in at least 5 (five) minutes before the transaction time.
8.3 For Standard Members Cashback is calculated at 1% (one percent), subject to a minimum spend of R100 (one hundred rand) and subject to clause 30 below.
8.3.1 For Premium Members Cashback is calculated at 5% (five percent), subject to a minimum spend of R100 (one hundred rand) and subject to clause 30 below.
8.4 Claims must be submitted within 24 (twenty four) hours of the Transaction Time.
8.5 A valid system generated Tax Invoice is required.
8.6 For Standard Members monthly limits apply to a maximum cashback payout of R200 (two hundred rand) per month and R100 (one hundred rand) maximum payout per claim.
8.6.1 For Premium Members monthly limits apply to a maximum cashback payout of R500 (five hundred rand) per month and R100 (one hundred rand) maximum payout per claim.
8.7 Only 1 (one) grocery Claim per Member per day is permitted.

9. Bolt Voucher Cashback
9.1 Bolt voucher cashback is available to Active Members who purchase eligible Bolt vouchers through the Platform.
9.2 Members may purchase vouchers within the diginuCashBack app, after which a voucher code will be issued and made available within the diginuCashBack application, found under “History” button.
9.3 Members must redeem the voucher within the Bolt app in accordance with Bolt’s redemption process.
9.4 Vouchers are valid for 30 (thirty) days from the date of purchase, after which they will expire if not redeemed.
9.5 Cashback is calculated at 5% (five percent) of the actual voucher amount redeemed within the Bolt app.
9.6 Cashback is subject to a minimum voucher value of R100 (one hundred rand) and a maximum voucher value of R10,000 (ten thousand rand) per transaction.
9.7 Cashback will be paid into the Member’s diginuPay Wallet on the first Friday following the date of voucher purchase, subject to validation and compliance checks.
9.8 Cashback is payable on the total monetary value spent on the voucher at the time of purchase, and not only on the monetary value used on the Bolt platform.
9.9 All voucher purchases are final and non refundable unless required by applicable law.
9.10 Use of Bolt vouchers is subject to the terms and conditions of Bolt, available at https://bolt.eu/en-za/legal/, and their privacy policy available at https://bolt.eu/en-za/privacy/.
9.11 diginuCashBack is not responsible for the services provided by Bolt, including but not limited to ride availability, pricing, service quality or voucher redemption issues within the Bolt platform or quality of any form of service offered by Bolt.

10. Upgrade or Downgrade of Membership
10.1 If a Member wants to upgrade their membership to a higher or longer term membership, the following options are available:
10.1.1 From Standard Monthly to Premium Monthly;
10.1.2 From Standard Monthly to Standard Annual;
10.1.3 From Standard Monthly to Premium Annual;
10.1.4 From Premium Monthly to Premium Annual;
10.1.5 From Standard Annual to Premium Annual.
10.2 Upgrading requires full payment of the relevant choice, subject to 10.1 above.
10.3 The balance of the existing membership in rand value will be reimbursed on a pro rata basis.
10.3.1 Reimbursement will happen into the Member’s diginuPay Wallet.
10.3.2 Reimbursement can take up to 2 (two) weeks.
10.4 Benefits, including cashback benefits and commission eligibility will instantly become available upon successful processing of Member’s payment.
10.5 No backdating of Claims will be allowed should Member upgrade during the allotted time from when they submitted a Check-in to when they claim, in order to increase benefit payouts, as set out in these terms.
10.6 Downgrading to any shorter period membership or from Premium Membership to Standard  Membership requires full payment of that Membership on the diginuCashBack App.
10.7 In the event of downgrading, the balance of the existing membership in rand value will be reimbursed on a pro rata basis.
10.7.1 Reimbursement will happen into the Member’s diginuPay Wallet.
10.7.2 Reimbursement can take up to 2 (two) weeks.
10.8 When the Member’s downgraded membership fee is processed, the member will instantly lose the benefits previously held.
10.9 Upon downgrade, no backdating of Claims will be permitted for open check ins.

11.Receipts and Claims
11.1 All receipts must be original, legible and system generated Tax Invoices and must clearly state “Tax Invoice” on the receipt.
11.2 Receipts must display the merchant name, date, time, items purchased and total amount.
11.3 Although unlikely to occur, diginuCashBack may request additional proof of payment, including bank statements, card slips, payment confirmations or other supporting documentation.
11.4 Duplicate, altered, reused, edited or fraudulent receipts are strictly prohibited.
11.5 Transaction splitting to bypass limits is not permitted.
11.6 No handwritten receipts or pro forma invoices will be accepted.
11.7 diginuCashBack may audit, verify, investigate or request supporting documentation relating to any Claim, referral activity, cashback benefit or promotional benefit.
11.8 Failure to provide requested supporting documentation, if and when requested, may result in the relevant Claim being declined and/or delayed.
11.9 Only one claim per Tax Invoice is permitted.
11.10 All four corners of the slip must be visible.
11.11 Folded slips, causing any information on the slip to be not clearly displayed could result in being rejected. 
11.12 For maximum cashback payouts, members need to adhere to clause 30 below.

12. Timing and System Requirements
12.1 Claims must comply with all timing requirements.
12.2 diginuCashBack is not liable for missed Claims due to system downtime, connectivity issues, device limitations, app version issues, user error or delayed submission.
12.2.1 In case of downtime, the Member should email diginuCashBack to cashback@diginu.com in order to provide verifiable timestamp.
12.3 The Member is responsible for maintaining access to a compatible Device and internet connection, as well as the latest version of the App.
12.4 The Member is responsible for submitting Claims correctly and within the required timeframes.

13. Fair Usage Policy
13.1 The Program is intended for personal use only.
13.2 Excessive, unusual, repetitive, artificial or suspicious Claim behaviour may be investigated.
13.3 diginuCashBack may limit, decline, delay or investigate Claims deemed abusive, excessive, suspicious or inconsistent with normal consumer behaviour.
13.4 Any attempt to exploit loopholes, technical errors, pricing errors, system errors or unintended system behaviour may result in reversal of benefits, account suspension or account termination.

14. Fraud and Misconduct
14.1 Fraudulent activity may result in immediate suspension or termination, pending thorough investigation.
14.2 Fraud includes fake receipts, duplicate claims, multiple accounts, system manipulation, false information, referral manipulation, collusion, transaction splitting, altered receipts and any attempt to unlawfully or unfairly benefit from the Program.
14.3 Members found to have engaged in Fraud may forfeit all cashback, referral commissions, wallet balances up to a maximum of what can be proved by diginuCashBack to have been Fraudulently enriched by, benefits and Promotional Offers linked to the misconduct, to the extent permitted by law.
14.4 diginuCashBack reserves the right to take legal action where necessary.
14.5 diginuCashBack may report suspected fraudulent, unlawful or abusive activity to the relevant authorities, payment processors, service providers or law enforcement agencies where appropriate.
14.6 diginuCashBack utilises extensive Artificial Intelligence software throughout the platform for, inter alia, the enhancement of customer experience, fraud detection, claim processing, abuse detection and data analyses.
14.6.1 Each Member might develop an internal risk-score determined by the Artificial Intelligence software.
14.6.2 Based on the Member’s risk score, claim processing might take longer in case of investigation required.
14.6.3 Risk score may be dynamic and can increase or decrease over time based on the Member’s compliance with the Terms set out herein.
14.6.4 Despite Artificial Intelligence being used for risk-scoring, diginuCashBack will use human intervention when investigating suspected fraud.

15. Referral Program
15.1 diginuCashBack offers an additional bonus opportunity to earn commission, which is in no way required, mandatory or dependant on cashback benefits, and is available at the Member’s sole decision whether they want to participate therein.
15.2 Any person, whether an active or inactive member, will automatically receive a unique referral link, and can share that link with any person in South Africa 18 (eighteen) years or older.
15.2.1 Only Active Members qualify for referral commissions.
15.3 Commissions are paid up to 5 (five) generations deep and are subject to compliance, validation and the applicable Profit Share Program Terms.
15.4 Referral earnings are governed by the diginu Profit Share Program Terms found at https://diginu.com/pspblueprint, as amended from time to time.
15.5 Participation does not create any partnership, employment, franchise, agency or representative relationship between the Member and diginuCashBack.
15.6 Referral relationships are recorded and determined solely by diginuCashBack’s system records.
15.7 diginuCashBack may amend, suspend or withdraw referral commission structures, qualification criteria, payout rules and referral benefits from time to time upon 30 days notice to Members.
15.8 Referral commissions are not guaranteed and are payable only where all applicable requirements have been met, as set out in these terms, subject to clause 15.4 above.
15.9 diginuCashBack’s main benefits are the cashback on Groceries, Fuel, Restaurants and Bolt, but offers the commission opportunity to active members as an additional optional extra, in order to achieve the vision of assisting 1 (one) million South Africans to benefit from the program.
15.20 Notwithstanding clause 15.9, diginuCashBack has no intention of ever removing the referral commission opportunity. 

16. Payments and Chargebacks
16.1 Payments are processed via third party providers.
16.2 By making payment, the Member agrees to the terms of such providers found at https://payfast.io/legal/general-terms-conditions/ and https://payfast.io/privacy-policy/.
16.3 If a payment is reversed, declined, failed or charged back, diginuCashBack may suspend the account and reverse any associated benefits, cashback or referral earnings.
16.3.1 In the event of charge back by the member, diginuCashBack reserves the right to Terminate the Member effective immediately upon being notified by Payfast of such charge back attempt, and any pending cashback payouts and/or commissions will be suspended effective immediately. 
16.4 The Member is responsible for any fees charged by their bank, card issuer or payment provider.
16.5 diginuCashBack may require identity verification, proof of payment, source of funds information or supporting documentation where required for fraud prevention, compliance, payment verification or regulatory purposes.

17. diginuPay Wallet
17.1 Cashback and commissions are paid into the diginuPay Wallet.
17.2 The wallet is not a bank account and does not earn interest.
17.3 diginuCashBack may use third party providers to facilitate wallet services.
17.4 Wallet fees may apply as follows:
17.4.1 Wallet to wallet transfer: R1.00 (one rand).
17.4.2 Electronic funds transfer: R10.50 (ten rand and fifty cents).
17.4.3 Instant electronic funds transfer: R49.00 (forty nine rand).
17.4.4 Cash withdrawal: R12.00 (twelve rand).
17.4.5 Monthly wallet maintenance fee: R1.00 (one rand).
17.4.6 SMS notification: R0.50 (fifty cents).
17.5 Wallet fees may be amended from time to time upon 30 (thirty) days notice to Members.
17.6 Where cashback, commissions or benefits are incorrectly awarded due to system error, human error, technical malfunction, incorrect data, fraud, abuse or any other error, diginuCashBack reserves the right to reverse, recover, offset or adjust such amounts.
17.7 If an amount is owed by the Member to diginuCashBack, diginuCashBack may offset such amount against future cashback, referral commissions, wallet balances or other amounts payable to the Member, to the extent permitted by law.
17.8 Wallets with no activity for 24 (twenty four) months may be classified as dormant and administered in accordance with applicable law and the terms of the relevant wallet provider.
17.9 Upon registering on the diginuCashBack platform, the Member will automatically receive a diginuPay wallet.
17.10 The Member’s diginuPay Wallet number will be their cellphone number they used to register on the Platform.
17.10.1 It is the Member’s responsibility to inform diginuCashBack in case their cellphone number needs to be changed, or in case it was entered incorrectly during registration, for whatever reason. 
17.10.1.1 In case the Member’s cellphone number has changed or is incorrect for any reason and they did not notify diginuCashBack in writing thereof, diginuCashBack will endeavour to assist the member in retrieving the money paid out to the old number, but cannot guarantee the retrieval thereof, and is hold harmless in the case of the Member not notifying diginuCashBack that their cellphone number needed to change.

18. Single Account Policy
18.1 Each Member is permitted to register and operate only one diginuCashBack account.
18.2 The creation, use or control of multiple accounts by the same individual is strictly prohibited.
18.3 diginuCashBack reserves the right to identify and link accounts using, but not limited to, personal information, contact details, payment information, device data, referral activity and usage patterns.
18.4 Where multiple accounts are identified as belonging to the same individual, diginuCashBack may, at its discretion:
18.4.1 Suspend or terminate all associated accounts.
18.4.2 Forfeit any cashback, referral commissions or benefits linked to such accounts.
18.4.3 Restrict the Member from future participation in the Program.
18.5 Any attempt to bypass this policy through the use of false information, third party identities or any other means will be treated as fraudulent activity.
18.6 Request proof of identity from the Member, and suspend the withdrawal of funds functionality on the Member’s diginuPay Wallet until the Member’s identity is verified.

19. Account Suspension and Termination
19.1 diginuCashBack may suspend or terminate accounts for breach of these Terms, suspected misconduct, Fraud, Abuse, failed payments, Chargebacks, unlawful conduct or any activity that may harm the integrity of the Program.
19.2 Accounts may also be suspended where required by law, regulatory authorities, payment processors or third party providers.
19.3 During suspension, the Member may lose access to cashback, referral commissions, Claims, Promotional Offers, wallet functionality or other Program benefits.
19.4 Termination may result in permanent forfeiture of benefits, cashback, referral commissions and Promotional Offers linked to the terminated account, to the extent permitted by law.
19.4.1 In the event of a member being terminated, diginuCashBack reserves the right to reject the terminated member from joining the program, or any of diginu's other products, services or offerings again in the future. 

20. Tax Responsibility
20.1 Members are responsible for complying with all applicable tax obligations in relation to cashback, referral earnings, wallet withdrawals and any other benefits received through the Program.
20.2 diginuCashBack does not provide tax advice to Members.
20.3 Members should obtain independent tax advice where required.

21. Privacy and Data Protection
21.1 Personal data is processed in accordance with applicable South African laws, including the Protection of Personal Information Act No. 4 of 2013.
21.2 Data is used for Program purposes, including membership administration, claim validation, cashback processing, fraud prevention, referral tracking, communication, analytics, compliance and service improvement.
21.3 Members agree that diginuCashBack may process personal information as described in the diginuCashBack Privacy Policy.
21.4 The Privacy Policy forms part of these Terms and is available on the Website.
21.5 diginuCashBack may display a Member’s details on the App to other Members, but strictly limited to:
21.5.1 Name and Surname
21.5.2 Cellphone number
21.5.3 Email address
21.5.4 Rank on the Leaderboard for personal members referred
21.5.5 Membership status, whether active or inactive
21.5.6 Date registered
21.5.7 Amount of personal referrals
21.5.8 Date of next payment of membership
21.5.9 Responses given on diginuCashBack Zoom Webinar Events, including but not limited to, reactions, poll answers, attendance status, and attendance duration.
21.6 The details in 21.5 are used strictly for purposes of achieving the intention of the program and to enhance Member experience for participation in the referral program.
21.7 A member may at any time request removal of these details by written request to cashback@diginu.com
21.7.1 The Member’s details will then be hidden from other Members, and the Member will not be able to see any other Member’s details as stated in 21.5 above. 

22. Electronic Communications
22.1 The Member agrees that notices, disclosures, statements, amendments, updates, warnings, confirmations and other communications may be delivered electronically.
22.2 Electronic communications may be sent through the Platform, email, SMS, WhatsApp, push notification, in app message or other official digital channels.
22.3 Communications shall be deemed received when transmitted by diginuCashBack, unless otherwise required by applicable law.
22.4 The Member is responsible for keeping their contact details accurate and up to date.
22.5 The Member agrees that if they unsubscribe from communication from diginuCashBack, they will not be informed about the status of their claims, nor reasons provided for rejected claims.

23. Third Party Providers
23.1 The Platform may rely on Third Party Providers, including payment processors, voucher providers, wallet providers, technology providers and external service providers.
23.1.1 diginuCashBack may provide Member details to the Third Parties outlined in these Terms, but only to the extend necessary to manage the Platform, and as permitted by relevant legislation. 
23.2 diginuCashBack has service level agreements in place with various service providers, but it is not responsible for failures, delays, outages, errors, fees or service issues caused by Third Party Providers, except where required by applicable law.

24. System Errors and Corrections
24.1 diginuCashBack may correct any system error, human error, pricing error, cashback calculation error, referral allocation error, wallet error or payment error.
24.2 Where an incorrect benefit, cashback amount, commission, wallet credit or Promotional Offer has been awarded, diginuCashBack may reverse, correct, recover or offset the incorrect amount.
24.3 The Member agrees not to knowingly exploit any system error, technical malfunction or unintended benefit.

25. Force Majeure
25.1 diginuCashBack shall not be liable for any delay, failure, interruption or inability to perform caused by events beyond its reasonable control, although it will endeavour to the best of its abilities to remedy any such occurrence(s) where possible.
25.2 Such events may include, but is not limited to, power failures, load shedding, internet failures, network outages, cyber attacks, strikes, riots, civil unrest, natural disasters, acts of government, acts of God, regulatory changes, banking failures, payment processor failures, third party provider failures or other circumstances beyond diginuCashBack’s reasonable control.

26. Liability Limitation
26.1 Participation in the Program is at the Member’s own risk.
26.2 diginuCashBack is not liable for any direct, indirect, incidental, special or consequential losses arising from use of the Platform, Program or third party platforms, to the extent permitted by law.
26.3 To the maximum extent permitted by law, diginuCashBack’s total liability to a Member shall not exceed the total membership fees paid by that Member during the preceding 12 (twelve) months.
26.4 Nothing in these Terms excludes liability that cannot be excluded under applicable law.

27. Intellectual Property
27.1 All intellectual property in the Platform, Website, System, Program, brand, trademarks, content, software, designs, data, processes and related materials remains the property of diginuCashBack or its licensors.
27.2 Members may not copy, reproduce, reverse engineer, modify, distribute, exploit or use any part of the Platform or Program without permission.
27.3 Members may never use diginuCashBack’s logo or App icon without the company’s written approval. 

28. Dispute Resolution and Jurisdiction
28.1 If a Member has a complaint, concern or dispute relating to the Program, Platform, membership, cashback, referral commissions, claims, wallet transactions or these Terms, the Member must first submit the matter in writing to diginuCashBack at cashback@diginu.com and allow diginuCashBack up to 30 (thirty) days to investigate and respond.
28.2 diginuCashBack and the Member shall endeavour to resolve any dispute amicably and in good faith before commencing legal proceedings.
28.3 Nothing in these Terms limits any rights that a Member may have under applicable consumer protection legislation.
28.4 These Terms and any dispute arising from or relating to the Program, Platform or these Terms shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.
28.5 Subject to applicable law, any legal proceedings arising from or relating to the Program, Platform or these Terms may be instituted in the courts of Pretoria, Gauteng, South Africa. The Member consents to the jurisdiction of such courts, provided that nothing in this clause limits any rights afforded to the Member under applicable law.
28.6 No failure, delay or relaxation by diginuCashBack in exercising any right, power or remedy under these Terms shall constitute a waiver of that right, power or remedy.
28.7 If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision shall be severed from the remaining provisions, which shall remain in full force and effect.
28.8 These Terms constitute the entire agreement between the Member and diginuCashBack relating to the Program and supersede any prior representations, communications or understandings relating to the subject matter of these Terms.
28.9 Any dispute concerning cashback calculations, referral allocations, qualification requirements, claim validation, member status, referral relationships or eligibility for benefits shall be determined based on the official records maintained by diginuCashBack, unless proven otherwise by the Member.

29. Good Faith Commitment
29.1 diginuCashBack is committed to operating the Program in good faith and delivering meaningful value to Members, to such an extend where Members want to share their pleasant experience with others.
29.2 These Terms will be applied fairly and reasonably, taking into account the interests of Members and the integrity of the Program.
29.3 diginuCashBack will continuously improve the Program and welcomes Member feedback by emailing cashback@diginu.com.
29.4 Where appropriate, discretion may be exercised to support fair outcomes without compromising the integrity, sustainability or fairness of the Program.
29.5 Members are expected to participate in good faith and contribute to a fair and trusted ecosystem.

30. Saved Loyalty Cards
30.1 The Saved Loyalty Cards feature enables a Member to scan and save eligible third-party loyalty cards within the diginuCashBack App for the purpose of assisting with the verification and processing of Cashback claims for Groceries.
30.2 A Member may save only one loyalty card per retailer or brand on their diginuCashBack profile. Multiple loyalty cards from the same retailer or brand may not be saved to the same Member profile.
30.3 Every loyalty card saved on a Member’s profile must be registered in the Member’s own name. A Member may not save a loyalty card belonging to any other person, including but not limited to a spouse, family member, friend, employer, business or any other third party.
30.4 By saving a loyalty card, the Member warrants that they are the lawful holder of the loyalty card and that all information submitted to diginu is true, accurate and complete.
30.5 diginu shall store the loyalty card number associated with each loyalty card saved by the Member. Where the same loyalty card number is identified on a qualifying Tax Invoice or other transaction data received by diginu, such loyalty card shall be regarded as the saved loyalty card for purposes of Cashback verification.
30.6 A Premium Member who has saved a loyalty card in accordance with this clause and who scans that same loyalty card during a qualifying grocery, fuel or dine out purchase shall qualify for Cashback at the applicable Premium Cashback percentage, provided that the claim complies with all other applicable provisions of these Terms and Conditions.
30.7 Where a Premium Member does not scan the loyalty card saved on their diginuCashBack profile during a qualifying grocery purchase, where a different loyalty card number appears on the transaction, where the loyalty card reflected on the transaction belongs to another person, where no qualifying saved loyalty card exists on the Member’s profile for that retailer or brand, or where the retailer does not operate a loyalty programme, the Member shall qualify for Cashback at a rate of 0.5% of the qualifying purchase amount, provided that the claim otherwise complies with these Terms and Conditions.
30.8 A Standard Member who has saved a loyalty card in accordance with this clause and who scans that same loyalty card during a qualifying grocery purchase shall qualify for Cashback at the applicable Standard Cashback percentage, provided that the claim complies with all other applicable provisions of these Terms and Conditions.
30.9 Where a Standard Member does not scan the loyalty card saved on their diginuCashBack profile during a qualifying grocery claim where a different loyalty card number appears on the transaction, where the loyalty card reflected on the transaction belongs to another person, where no qualifying saved loyalty card exists on the Member’s profile for that retailer or brand, or where the retailer does not operate a loyalty programme, the Member shall qualify for Cashback at a rate of 0.1% of the qualifying purchase amount, provided that the claim otherwise complies with these Terms and Conditions.
30.10 For purposes of this clause, a loyalty card shall be regarded as having been scanned where the loyalty card number recorded during the transaction corresponds with the loyalty card number saved on the Member’s diginuCashBack profile, irrespective of whether the loyalty card was scanned from a physical card or from a digital version displayed on their diginuCashBack App.
30.11 diginu reserves the right to verify the ownership of any saved loyalty card and may require the Member to provide any information or documentation reasonably necessary to confirm that the loyalty card is registered in the Member’s name.
30.12 diginu may reject, suspend or remove any saved loyalty card where it reasonably believes that the loyalty card does not belong to the Member, has been fraudulently obtained, has been altered or manipulated, or where the Member fails to provide satisfactory proof of ownership upon request, in the case where diginu cannot verify the card details through integration with other platforms. 
30.13 Any attempt to save, upload or use a loyalty card that is not registered in the Member’s own name, or any attempt to manipulate or circumvent the verification process contemplated in this clause, shall constitute a material breach of these Terms and may be treated as fraud.
30.14 Saving a loyalty card and scanning that loyalty card during a transaction does not guarantee approval of any Cashback claim, all of which remain subject to these Terms and Conditions and any other applicable eligibility requirements.
30.15 By saving a loyalty card, the Member authorises diginu to collect, store, process and use the loyalty card number and related transaction information for the purposes of Cashback verification, fraud prevention, claim validation, customer support, system administration and compliance with applicable law.
30.16 diginu may verify the ownership details of the loyalty card holder through third party intrgration with other platforms.
